Late Fee Waivers

TDA shall have final authority to determine whether you qualify for a waiver for remitting your fee after the license expiration date.
TDA may waive late fees only under the following circumstances:

Incapacity from serious illness or injury.
If you were incapacitated and unable to address renewal or invoice matters due to serious illness or injury during most or all of the renewal period, you may be eligible for a waiver.  To request this type of waiver, you must provide evidence to TDA - either copies of medical records or a letter from your physician.

Fatal or life-threatening illness or injury of a family member.
If a  member of your immediate family experienced a fatal or life-threatening illness or injury during the renewal or invoice period, you may be eligible for a waiver.  To request this type of waiver, you must provide evidence to TDA- either medical records or a letter from the treating physician. 

Catastrophic loss to business property.
If you suffered a catastrophic loss to a significant amount real property or inventory that you used for activities related to the fee, you may be eligible for a waiver.  The loss must occur during the year before your payment was due and be the result of circumstances beyond your control (or the control of your agent or representative).  To request this type of waiver, you must provide evidence such as:  official loss appraisals, pictures authenticated by affidavit, or other similar records.  TDA considers weather-related damages to be beyond human control.

Alleged failure to timely receive renewal notice.
If TDA records show that it did not send your renewal notice to your last known address on or before the 30th day before your license expiration, you may be eligible for a waiver.  To request a waiver, you must send TDA any documentation of your current address (as of the date of the waiver request).

TDA will not grant a waiver of late fees under this clause if you failed to notify TDA of a change of address, and the mailing of the renewal notice to your previous address appears to be the primary cause for the late fee payment.
